Charles' Eminent DomainPFT’s recent win before the Supreme Court in Dillard v. Fulton County was featured in the Daily Report on July 24th. The article, titled “High Court: Fulton on Hook to Buy Property for $5M”, reviewed the County’s attempt to dismiss the case after a special master award they thought was too high. The correct procedure for disputing an award would be appeal. However, as Charles is quoted saying “[i]t’s clear this was an intentional, strategic decision made by the county not to appeal, and I suspect they were afraid they might have to pay more,” Pursley said. “If you have confidence in your appraisal, why would you not appeal?”. The Supreme Court agreed, and confirmed in their ruling that a special master’s award may not be unilaterally dismissed.

charles PFT’s condemnation team, led by Partner Charles Pursley along with Associate Angela Robinson, won a major victory in the Georgia Supreme Court last week in Dillard Land Investments, LLC v. Fulton County, a condemnation case involving the taking of commercial property. The Supreme Court affirmed that a condemnor cannot unilaterally dismiss a case once the special master award has been finalized. The impact of the decision ensures property owners’ rights to full just and adequate compensation and provides more certainty in the condemnation process . The Surpreme Court’s July 11th decision closely mirrored Mr. Pursley’s oral argument before the Court.
