The Court found the zoning was unconstitutional, null and void.  On October 9th, the Fulton County Daily Report featured the victory in “Judge Calls Foul on Rezoning Around Gwinnett Braves Ballpark,” highlighting the Court’s ruling.  According to the Order, the County’s errors include allowing a non-owner to apply for rezoning without consent of the owner, publishing legal notices of the rezoning hearing that erroneously identify the owner as Brand Properties, and failing to post proper signs on each parcel to give notice of the rezoning.
